Dealer Requirements:
In order to be considered for dealer status, applicants must have a registered business and licensed by your local State or National agency. In addition, your business should either have a physical retail location or a fully functional eCommerce site. The primary focus of your business must be motorcycles or motorcycle parts. Dealer Terms and Conditions:
Minimum Advertised Pricing(MAP)
The Minimum Advertised Price for any Avail product is 5% off the listed price on the the Avail Motorsports website. This includes price changes when added to cart or checkout, as well as “Group Buys” and similar promotions. Dealer prices are available online with your approved dealer account by signing into your associated email account on file. It is the sole responsibility of the dealer to maintain current pricing. All prices, products and terms are subject to change without notice. Orders are accepted based upon prices and terms in effect at the time of shipment. Acceptance of shipment constitutes acceptance of these terms.
MAP violations will be addressed by a notification of compliance either by phone or email. The dealer account may be placed on hold until the required changes are completed. If a dealer does not comply with the MAP policy or there are multiple violations within a single year, permanent termination may occur.
Shipping
All orders will be dispatched via USPS unless otherwise stated. It is the responsibility of the buyer to keep Avail Motorsports informed of any address changes in writing and any charges incurred as a result of failure to inform Avail Motorsports will be the sole responsibility of the dealer.
Returns
All returns must be approved before Avail Motorsports will accept them. All returns must be sent back in new and saleable condition, including all product packaging. No returns will be accepted on closeout items, purchases older than 30 days, or items that have been installed or damaged. Returns may not be accepted unless a mistake has been made on behalf of Avail Motorsports or an item is deemed defective.
Service Related Products
Products being sold with services completed by Avail Motorsport must be indicated as such. Advertising products in which Avail Motorsports has completed a service upon, under false pretense in which the dealer/distributor claims is work of their own, is considered unacceptable and violations will be addressed by a notification of compliance either by phone or email. The dealer account may be placed on hold until corrected, or terminated permanently at the discretion of Avail Motorsports.
Redistribution of Product
All Dealers/Distributors are at the approval and discretion of Avail Motorsports. Any and all redistribution of products to unapproved vendors or businesses will be grounds for termination.
Liabilities
All Avail Motorsports products are guaranteed against defects in material and workmanship. Avail Motorsports will, at our option replace or issue credit for defective products. Avail Motorsports makes no other warranty of any kind, expressed or implied. The use of Avail Motorsports items may render some vehicles illegal for road use in some states and the dealer assumes full responsibility for the disclosure to the customer of all state and federal laws pertaining to the use of these products on public roads. Many Avail Motorsports products are designed for racing use only and it is the responsibility of the dealer to recognize the intended use of the product and advise the customer accordingly. Avail Motorsports will not be held liable for any loss or damages incidental, direct or indirect from the use of, or inability to use, Avail Motorsports products. Any product modifications outside of those expressly stated in the instructions will void all warranties.
